The California False Claims Act, administered through the state’s Office of the Attorney General, aims to recover monies fraudulently obtained from the state through submission of false documentation. The attorney general retains the power to initiate a civil case for treble damages, as well as civil penalties, against a person or corporation that intentionally misleads the state through false claims in statements or documents in order to achieve financial gain. California’s False Claims Act, like those of New York and other states, is modeled on the original federal statute signed into law by President Abraham Lincoln in 1863, and as amended in 1943 and subsequently. The False Claims Act focuses on alleged acts of fraud committed against the nation’s or a state’s taxpayers, including fraud involving banks, contractors, and Medicaid or Medicare.
